Question Asked:

We request the following documents and information from Cheshire Fire and Rescue Service in relation to the Fire at Beechmere Extra Care Premises, Rolls Avenue, Crewe, Cheshire on 8 August 2019:

  1. CFRS Incident Log from the Fire

  2. CFRS Incident Recording System (or Fire Damage Report) from the Fire

  3. CFRS Central Risk Registers from 2018 - 2020

  4. CFRS water management policies from 2018-2020

  5. Clarification as to the role and involvement of Fire Investigator Mr Martindale who attended the Fire, and copies of notes taken by Mr Martindale immediately following the Fire.


Our Response:

I can confirm that Cheshire Fire and Rescue Service does hold the information in question however, after careful consideration we regret to inform you that we are unable to provide the requested information under Freedom of Information for the following reasons: 

Section 30 (1) (c) allows an exemption to be applied when the authority has a duty or power to investigate or prosecute. Cheshire Fire and Rescue has that power. The information is exempt as it is held by the authority (Cheshire Fire and Rescue Service) for the purpose of any criminal proceedings which the authority has the power to conduct.
